Oso Grande offers critical datacenter and network access services to many organizations, and keeping those services operating at a high level is paramount to the continued success of everyone involved. To ensure consistent delivery of those services, we require that our customers comply with the following rules and regulations when utilizing the colocation services; these and other requirements may be listed in your Master Services Agreement.
General Rules and Regulations
- All Oso Grande Customers and their representatives, employees, contractors, agents and users of Customers' facilities are subject to these Rules and Regulations in connection with their use of Oso Grande Colocation Services.
- Customer shall not, at any time or in any way, sub-lease, sub-license or resell, use of Oso Grande Colocation facilities or services without Oso Grande ’s prior written consent with such consent not to be unreasonably withheld.
- All new equipment installation activities must be approved by Oso Grande, which consent shall not be unreasonably withheld or delayed, except for those that are required for normal maintenance and repair. Unless otherwise elected by Oso Grande in writing, only Oso Grande or its designated agents shall connect or install a cross-connect in the Colocation Facility.
- Customer and its representatives shall not approach, handle, use, inspect or examine in any way any other equipment but their own. Customer and its representatives shall not approach, touch or handle in any way, Oso Grande ’s raceway, cabling, ladder racks, conduits, panels or cabinets.
- Customer’s use of the Colocation Facility and the building in which it is located shall at all times comply with the rules and regulations promulgated by the owner of such building from time to time, a copy of which may be obtained from Oso Grande.
- Customer representatives shall not disclose the identity of any Oso Grande clients without Oso Grande’s permission.
- The Colocation Facility shall be kept neat and orderly at all times. Customer representatives shall remove all trash and debris upon departure from the Data Colocation Facility. Oso Grande shall have the right to remove and discard any trash and debris left in the Colocation Facility in violation of the foregoing.
- At conclusion of work being done in the Colocation Facility, Customer shall ensure all cables are routed and dressed neatly in cabinets and all doors are closed and locked.
- Use of freight elevator is available for large equipment delivery only with prior Oso Grande approval.
- Customer Equipment must be configured and run at all times in compliance with the manufacturer's specifications, including power outlet, power consumption and clearance requirements. Customer shall comply with UL power guidelines and Customer’s utilization of all power circuits shall not exceed 80 percent of the branch-circuit ampere rating.
- If Customer’s power service is delivered and contracted as a “redundant power service”, Customer’s equipment shall not exceed 80 percent of the branch-circuit ampere rating of one of the circuits – eg, if customer receives 20 amps of redundant power (40A total), customer shall not consume more than 16A of power at any time (20A * 0.8 = 16A).
- No sign, advertisement, notice or object shall be displayed by a Customer in or on the exterior of the Colocation Facility walls, doors, ceilings, cabinets, or racks without Oso Grande ’s prior approval.
- No Customer, nor any of Customer’s representatives or visitors, shall at any time bring into or keep upon the Colocation Facility premises any hazardous, inflammable, combustible, explosive or otherwise dangerous fluid, chemical or substance at any time.
- No acids, vapors or other materials shall be discharged or permitted to be discharged into the waste lines, vents or flues of the Colocation Facility.
- Customer may not bring, or make use of, any of the following into the facility: Food or drink, tobacco products, explosives, weapons, chemicals, illegal drugs, alcohol or other intoxicants, electro-magnetic devices, radioactive materials or recording equipment of any kind (other than tape back-up or monitoring equipment).
- Oso Grande reserves the right to inspect all objects to be brought into or taken out of the Colocation Facility and to exclude from the Colocation Facility all objects which violate any of these Rules and Regulations. Oso Grande may require any person entering or leaving the Colocation Facility with any package document the contents of the said package.
- All connections to and from Customer’s equipment must be clearly labeled. Customers may use Oso Grande ’s labeling code or choose to use their own code. All Customer labeling codes must be provided to Oso Grande for purposes of configuration control.
- Periodically, Oso Grande will conduct routine scheduled maintenance of its Colocation Facility and Colocation Services. Oso Grande shall notify Customers a minimum of 7 calendar days in advance of said maintenance. Customer agrees to cooperate with Oso Grande during the scheduled maintenance so that Oso Grande minimizes Customer impact.
- All Customer equipment must be installed such that any generated hot air is exhausted into the hot aisle or otherwise contained away from the cold aisle. Customer agrees to remedy any adverse air flow issues, at Customer’s sole expense, upon Oso Grande ’s request.
Access and Security
- Only those individuals specifically identified by Customer on the authorized personnel list maintained by Oso Grande may access the Colocation Facility.
- Customer will notify Oso Grande in writing of any change in Customer's representatives.
- Customer representatives shall stay in the vicinity of their own equipment when in the Oso Grande facility.
- Customer, including but not limited to, its representatives or escorted vendors or visitors are required to sign the access log located in the Colocation Facility upon entry and exit.
- “Tailgating” is prohibited. Tailgating is the act of following an authorized individual into the Colocation Facility without authorization.
- Customer shall not access the building roof, electrical closets, chases, or risers without prior consent from Oso Grande.
Conduct Guidelines
- Customer and its representatives may not misuse or abuse any Oso Grande property or equipment.
- Customer and its representatives may not harass any individual including Oso Grande personnel and representatives of other Customers of Oso Grande.
- Customer and its representatives may not engage in any activity that is in violation of the law or aid in criminal activity while on Oso Grande property or in connection with the Colocation Services. Customer and its Representatives may not assist or permit any persons in engaging in any of the activities described above. If Customer becomes aware of any such activities, Customer will use best efforts to stop such activities immediately, including, if necessary, terminating Customer's user's access to Customer's online facilities.
- Customer and its representatives may not infringe or misappropriate the intellectual property rights of others. This includes posting copyrighted materials without appropriate permission, using trademarks of others without appropriate permission or attribution, and posting or distributing trade secret information of others in violation of a duty of confidentiality.
- Customer and its representatives may not violate the personal privacy rights of others. This includes collecting and distributing information about users without their permission, except as permitted by applicable law.
- Customer and its representatives may not send, post or host harassing, abusive, libelous or obscene materials or take any similar actions.
- Customer and its representatives may not intentionally omit, delete, forge or misrepresent transmission information, including headers, return addressing information and IP addresses or take any other actions intended to cloak Customer's or its users' identity or contact information.
- If Customer becomes aware of any such activities, Customer will use best efforts to stop such activities immediately, including, if necessary, terminating Customer's user's access to Customer's online facilities.
Right to Deny.
Oso Grande reserves the right to deny access to anyone not adhering to the above rules.
